Biography

Attorney Smith is a strong advocate for the rights of injured and disabled. He possesses over 20 years of legal experience. After graduating with honors from Boston University School of Business Management, he started his career as a workers compensation claims adjuster.

Attorney Smith soon realized he could accomplish more in his career if he earned a Law Degree. He decided to attend Suffolk University Law School on Beacon Hill, Boston, MA. Soon after graduation, he worked briefly at a prestigious Insurance Defense Firm in Boston, Massachusetts. He quickly realized he did not want to represent big insurance companies and employers against the working class.

Attorney Smith then took his talents to Lowell, Massachusetts and practiced law at one of the largest plaintiff oriented law firms in Merrimack Valley. It was there he determined it was his calling to represent the less fortunate and pursue injury and disability claims on behalf of clients and their families. After handling personal Injury, disability and workers compensation matters for over a decade in Lowell, he was offered an opportunity to work at one of the largest plaintiff personal injury firms in the State of Massachusetts. While at this firm in Boston, he handled countless workers compensation and third party claims on behalf of his clients.

After working at a large specialty plaintiff personal injury law firm, he decided he could properly serve the needs of his clients if he stated his own law firm. Attorney Smith is the founder of the Mass Injury Group. His firm represents hundreds of clients across the state of Massachusetts. His firm specializes in handling all types of injury claims including motor vehicle and pedestrian accidents, wrongful death claims, negligence claims, premises liability cases, workers compensation injuries and social security disability matters.

Attorney Michael O. Smith has handled countless jury and non-jury trials.

Legal Answers
14 Questions Answered
Q. My father was killed as a passenger in an auto accident I would like to get a lawyer to sue the driver?
A: I strongly suggest you speak with an experienced wrongful death lawyer in your area to see if you have a viable claim. First, an administration of your Father's estate will need to be set up and I am assuming you would be the appointed as the administrator. In order to bring a claim for wrongful death against the driver, you will need to establish negligence.

Wrongful Death claims can be tricky and there is a statute of limitations to file a lawsuit, so I again encourage you to contact an experienced personal injury lawyer who could advise you of your options
Q. I'm on 34A in Massachusetts and my adjuster refuse to pay me is this legal
A: I concur with the previous answer. It is difficult to answer without further information. Generally speaking, if the WC insurer does not have permission by the Department of Industrial Accidents to stop your checks and you have not settled your case or gone back to work, then the stoppage of your checks could be considered illegal. There are other times your checks could be suspended. The insurer has the right to suspend your checks if they can show you failed to attend an IME.

If you have an attorney I strongly encourage you to speak with your attorney. If you are not represented, I encourage you to reach out to an experienced WC attorney in Massachusetts.
Q. Could I potentially have a malpractice claim?
A: Sorry to hear about your situation and the complications you are experiencing. Clearly, you have suffered damages. The question will be whether the staff at the initial ER visit deviated from the standard level of care and due to their alleged mistake in failure to diagnosis, you were harmed.

Most medical malpractice cases require an expert doctor to testify and state there was negligence on behalf of the ER and staff and that negligence caused your harm. I strongly suggest you contact an experienced personal injury and medical malpractice attorney to further discuss whether you have a viable claim.
