Q. Is it a crime to State your wrong address on the bankruptcy application and have people also cover for you you
A: Both of those items are wrongful and fraudulent and a crime under the Bankruptcy statutes. You sign the Petition under the penalty of perjury. As for running up the cards, if you file too soon it will be seen as no intention to repay and dismissed as bad faith. Do not do either of these things
Q. Filed bankruptcy petition in may, earlier in the day of auction of house. Was told automatic stay would be done.
A: No, automatic stay is automatic, goes into effect upon filing.
Q. Can You File Chapter 7 Bankrupt on medical bills
A: As long as you do not have a house with equity, you should be okay to file a Chapter 7
Q. Can I prevent my husband from filing for bankruptcy? Does he need my permission in order to do so?
A: No you can not technically prevent him from doing it. Although he is required to include your income for the last six months and prove.same via paystubs.
Q. Halfway thru a Chapter 13 (100%). House not included but I want to surrender it now. Will I have to pay a deficiency?
A: You should have the schedules and plan amended then possibly you will be protected against the deficiency Judgment
Q. I am experiencing major credit card debt related to chronic illness and disability.
A: There is really no reason not to file, but you should be sure that there is nothing you are missing or have some assets that would be at risk. Check with counsel there
Q. A creditor was awarded a civil judgement 6 days after I filed for Chapter 7 and that is now on my public record.
A: Have the State Court issue an order coiding the judgment. You can probably do it with a letter with proof of filing. Call the state court clerk or judge's chambers that issued the order.
Q. Will my employer be notified if I file for bankruptcy?
A: Usually an employer is not advised of the bankruptcy, unless you are in a Chapter 13 and the Trustee orders that the Chapter 13 Plan payments be deducted from your wages directly.
Q. Can I stop a foreclosure on my home if I file for bankruptcy? How fast will it work?
A: If this would be your first time filing, the automatic stay goes into effect in most states immediately, and you can advise the sheriff / Constable /Court Officer upon receiving your case # that the stay is in effect.
