Q. How much would it cost me to file for bankruptcy if I owe 15,000?and I am not an American citizen. I have a green card
A: Lawyers charge anywhere from 1500 to 3500 + court costs
Q. I am current on all my bills but have been using my 401k to stay afloat. I am almost out of money, what are my options?
A: Stop taking money out of 401k and file for Chapter 7
Q. How long do you have to wait until applying for bankruptcy, when you bought some stuff.
A: You should wait at least 90 days for big purchases, if normal everyday things 30 days
Q. Do parents need to go to the court with you for a speeding ticket if your a minor?
A: It is not required, but I would recommend it and judge may advise you to bring them.
Q. debt collector suing me for a car repoed 2 years ago. What are my options to stop company from garnishing wages, etc.
A: As long as that is not the only debt, and you do not have the vehicle, then bankruptcy is an option.
Q. If I move and declare bankruptcy in another state, will the California exemptions be able to be used?
A: Exemptions are determined by the state in which you are residing in when you file. You must be a resident for 180 days.
Q. Hi I filed BK in 2011 and in schedule F it listed my private student loans. My BK was granted does that mean it was dis
A: Student loans are not usually discharged unless you filed an adversary proceeding and proved the requisite elements. So I would doubt that they were discharged. I would also suggest contacting your counsel if you filed through one
Q. My parents are victims of a car accident and the guilty party is uninsured, what now?
A: Your father maybe correct as there is, in NJ, Uninsured and Underinsured Motorist coverage. This goes into effect when the at fault person either does not have any insurance or has minimal insurance. Now depending on injuries, they may or may not qualify, but your parents insurance will take care of the damage or total the car.
Q. I cosigned on a vehicle for my son and now he is putting it into his bankruptcy. Will the lender come after me?
A: Probably will come after you on the deficiency after they repossessed the vehicle.
