Mastering Scientific Evidence in DUI-DWI Cases

Activities: Mr. Head started this series of Forensic Evidence in Atlanta on October 14, 1994. In 2004, the series was taken over by the Texas Criminal Defense Lawyers Association and the National College for DUI Defense. Mr. Head was a featured speaker for most of the programs, but has now deferred being a speaker in favor of letting other lawyers be in the spotlight. An average of 200 attendees have taken this seminar for the last 10 years. The current program has being conducted in New Orleans the past five years, but prior programs have been held in Dallas, Houston, Miami and Gulfport, MS, after several successful programs in Atlanta.

Q. Does Georgia have a statute of limitations on felony probation violation warrants
A: Well, once a person skips out, the prosecutor usually goes to a judge to get a "tolling" order, meaning that time stops, until they find you. Plus, Georgia has a statute that says that once you are OUT of the State of Georgia, the statute of limitations it "tolled." Best to get a criminal defense lawyer to start helping you find and "end" to this cat and mouse game
Q. I was traveling down Highway 80 turning on 21 in Garden City and I slow down to make the left turn the container tilted

A: Well, the question, without more, is sort of like asking a doctor, in a first telephone call, is my stomach ache going to be fatal? Far too much missing information to tell you that. Shifting cargo will be blamed on someone, and if the DRIVER loaded it, he or she is more likely to be at fault, civilly and criminally. See an attorney, to get targeted and valuable legal advice.
Q. In st.of Ga, Fl. driver get violations: 5 counts endangering a child while under influence? Is is possible to beat such?
A: Child endangerment creates a NEW DUI charge for EACH child, and these are stacked, end to end. So, with a DUI driver, and 5 children under age 14 in the vehicle, this is potentially 6 DUI charges, DUI #4, DUI #5 and DUI #6 will all be accused as DUI felonies. If this does not convince you to get a TOP DUI LAWYER, I cannot think what would. Perhaps considering how many DECADES before this person will ever be able to drive, if at all. A 4th DUI for a Florida licensee is a lifetime ban on driving again.
Q. Had a wreck and went to court was told the person I hit works their so they can't take care of case someone else has to?
A: Sounds like the judge or prosecutor or both have to "recuse" themselves, from your case. This happens in all courts, including the U S Supreme Court. You need to get an attorney to assist you, either public defender or private lawyer. Accident cases can have many unexpected issues, and potential liability that is beyond what your insurance can cover.
Q. Will avoiding the detectives make them drop the case?
A: It is no longer your final decision, about whether charges are brought. The report, and subsequent investigation can support the charge. The police will need you for the prosecution, but if you fail to obey a subpoena, you can be held in contempt of court. Plus, you cannot remain silent, once on the witness stand. You are not married, and you have no marital privilege.
Q. Is a fight with the parent of your child considered domestic violence
A: Yes. If done in the child's presence or observation (e.g., hearing it, seeing it), then you can face domestic charges.
Q. Can I press charges on boyfriend if it's been a week since he cut me? But I told the hospital I did it cooking
A: Yes, the case can be reported to the DA, but I'd do this with guidance and oversight from a public defender or private criminal defense lawyer. This is because LATE reporting is always suspected as being false or retaliatory. Plus, if you received public funding for medical treatment, lying about the circumstances might be considered a criminal act. Posting a message like this only touches the immediate question, but your criminal history and other factors will determine the wisdom of moving forward with this criminal charge.
Q. Can a person get arrested for making false claims about child abuse?
A: It sounds like a crime, and possibly is a crime. Various statutes control such harassing behavior, even if it is being done to another party. If you have a criminal defense lawyer, ask him or her about whether the attorney will assist you in presenting this set of facts to the District Attorney for the county where this reporting is being made. The State agency is likely sick and tired of wasting their resources, and time, too. I prefer --- strongly --- having a trained lawyer go with you.
