- Q. Can my husband sell the house without my consent, despite being jointly owned and no divorce filed?
- A: If the property is located in NC, a realtor is going to insist that you execute a quitclaim deed releasing your marital interest in the property before a buyer to take clean title to the property. Is it possible for him to sell it without you? Yes. Is it likely? No. You should contact a divorce or family law attorney ASAP, and record your marital interest to put potential buyers on notice that you have an interest that needs to be addressed.
- Q. What can I do to enforce visitation rights with granddaughters in NC?
- A: That depends on whether your "agreement" was a court order, or a Separation Agreement between your son and your daughter in law, and whether your daughter in law is a fit parent. You won't be able to file an action to obtain legal rights as a grandparent, unless you were a party to a court order or a party (or third party beneficiary) of their Separation Agreement. Consult with a family law attorney in your area, for more specific options once the attorney can clarify some of the issues of your case.
- Q. Handling property division after divorce and considering mediation with financial constraints.
- A: First of all, I agree with everything said by Attorney Aarasmith. Additionally, since you are in NC, the answer depends on whether, prior to your divorce decree being entered, either of you filed to preserve your right to have a court decide your dispute, via filing a claim for equitable distribution (in the event the two of you cannot agree via mediation or another method of alternative dispute resolution). If you didn't, you have both lost that opportunity, and now if you cannot agree, you (or your ex) would need to file a Petition to Partition the house, which will force the house to be sold if one cannot buy out the other.
