Q. what is the punishment for possesion of less than a gram of meth?
A: 180 days to 2 years in State Jail, with deferred being the most likely outcome.
Q. My daughter missed court for her third DWI and has a warrant out for her arrest. Is there a statute of limitations?
A: The warrant is last until she apprehends her. There is no statute of limitations or expiration date on the warrant.
Q. What can I do when a clerk forgets to close a case that was supposed to be dismissed as part of a plea deal?
A: The attorney who handled the plea for you should be able to speak to the clerk and get that resolved relatively easily, if that was the agreement that was made.
Q. Can a parent sign consent for her you 14 yr old dating a 17 yr old?
A: No. A parent cannot give consent for the 14-year-old, nor can the 14-year-old give consent to sexual contact. For indecency with a child, there is an affirmative defense if the actor is no more than three years older than the victim. A similar provision exists for sexual assault. However, remember an affirmative defense means you can raise the defense in court. It won't prevent an arrest or a case being filed. Hiring an attorney and bonding out after an arrest are both expensive propositions. To learn more about the age of consent in Texas:
Q. My son is in jail on a $50,000.00 bond. How do I go about getting him a bond reduction.
A: His defense attorney will approach the judge about a bond reduction if appropriate. Here is more about bonds:
Q. A person cannot drink while serving probation for DWI. Does that condition apply if they serve jail time on weekends?
A: It is possible but unlikely that she is serving days in jail - even over weekends - as a condition of probation. It sounds like she is serving a jail sentence on weekends. If she's serving jail time, there are no conditions other than going to jail when she is supposed to. If she's serving a probated sentence, then her probation officer would likely revoke her if she violated a condition of probation such as consuming alcohol when she was ordered not to. That is, however, most likely not the situation based on what you've described.
Q. If I do not testify against someone can they still get charged? I didnt want anyone to go to jail and I did not call 911
A: Yes. I have seen prosecutors try cases without victims there to testify and still get guilty verdicts.
Q. Can the d.a pick up a case without a statement
A: Yes, they can.
Q. I was charged with agervated assault and my girlfriend said I did not hit her can the cops file charges
A: If they have independent proof of the assault, they can file charges without her cooperation.
