I am Brian P. Kinder, the managing partner at The Kinder Law Group, APC, where I focus solely on Intellectual Property ("IP"). For over ten years, I have been dedicated to helping my clients develop and safeguard their valuable IP rights globally, with a comprehensive understanding of both domestic and international laws related to patent, trademark, copyright, trade secret, false advertising, and franchise.
In the transactional aspect of my work, I concentrate on aiding clients in safely marketing and distributing their products and services worldwide. I manage and advise on trademark clearance searches, as well as the preparation and submission of patent, trademark, and copyright applications to the U.S. Patent and Trademark Office (U.S.P.T.O.) and Copyright Office. Throughout my career, I have managed extensive domestic trademark registration portfolios and participated in some of the world's largest brand campaigns, covering over 120 countries. I regularly draft and negotiate various agreements including license agreements, work for hire agreements, athlete endorsements, model releases, website use policies, and trade secret protection policies and procedures.
In the litigation side of my practice, I have substantial experience in both defending and prosecuting disputes in various federal and state courts, the Trademark Trial and Appeals Board (T.T.A.B.) in Washington, D.C., and the World Intellectual Property Organization (WIPO) in Geneva, Switzerland. I have handled numerous cases involving patent, trademark, and copyright infringement, false advertising, unfair competition claims, misappropriation of trade secrets, and franchise disputes, making strategic use of discovery and motion practice to achieve favorable outcomes for my clients.
