Q. What is the jurisdiction for a hit and run auto accident [driver that caused fled & not found] when it is out of state?
A: Generally, venue is proper where the accident occurred or where defendant resides. In this case, venue would most likely be proper where the accident occurred since defendant was not found. It’s possible that the lawyer you decide to hire may be able to locate defendant’s whereabouts. At that point, multiple jurisdictions could be applicable.

It should be noted that in situations where plaintiff and defendant reside in different states and the amount in controversy exceeds $75,000, defendant may remove the case to Federal Court. I would suggest that you look for counsel in the state where the accident occurred to start. Q. What would be the next best step for me to do when can't find attorney to take my case?
A: Even though the other party may not have responded to your lawsuit, it does not make it a guaranteed “win.” There may be procedural issues with notice and service of process. I would advise reaching out to your local state bar association to see if they may be able to refer a competent attorney for your matter. Before representing yourself in court as a pro se litigant, I would advise trying to exhaust all possible avenues in your pursuit of retaining a lawyer. Generally, a lawyer has very specific knowledge regarding the rules of civil procedure and they can provide you with specialized guidance on how to properly litigate your matter.
