Dave Gormley is a Partner and the head of our Bankruptcy and Real Estate departments. He has been handling bankruptcy and foreclosure cases for over 10 years. There isn’t much related to bankruptcy or foreclosure he has not already seen. Dave is admitted to practice in Maryland and the Federal Courts, including the U.S. Bankruptcy Court and the U.S. Supreme Court. He lives near Annapolis with his family.

- Q. Will I lose my home after filing chapter 7 bankruptcy if I don't owe anything on it and it's worth $65,000?
- A: Currently Virginia bankruptcy exemption. However it is my understanding that this is changing. You should consult with a bankruptcy lawyer and see what this new law will mean if it become law. You would probably still loose your house, but you could exempt more of the equity from your house. The new exemption may let you protect up to $25,000 in equity if it becomes law. It could also make it so you could pay less of your debt and still protect your house in a Chapter 13. However, with the drop in income you experienced it may be time to think of letting the house go.
- Q. What forms do I need for a chapter 7 and is there a packet
- A: You can check the bankruptcy court's website for information on the forms.

They also have information on representing yourself. At the very least get a consultation with a bankruptcy lawyer. Representing yourself is difficult and can make things worse.
- Q. Can I add a cover letter with additional information for the trustee when filing my chapter 7 petition?
- A: You probably just want to send the cover letter with the document production you send the Trustee after the case is filed.
