Q. Timeline for completing course after signing Paternity Acknowledgment in Florida
A: In Florida, the Respondent must complete the course within 45 days after acknowledgment of paternity by that party, adjudication of paternity of that party, or an order granting time-sharing to or support from that party, unless excused by the court for good cause. If the Respondent did not take the course within the 45-day timeframe, they can still complete the course during the case.
Q. Are inherited assets during marriage divisible in divorce?
A: Under Florida law, assets inherited by one spouse during the marriage are generally considered nonmarital property and are not subject to division in a divorce, provided they are not commingled with marital assets or used in a way that converts them into marital property. Inherited assets may become marital property if they are commingled with marital funds, used for marital purposes, or if their value is enhanced due to marital efforts or the use of marital funds. Their classification can change based on how they are managed during the marriage. I recommend consulting with a family law attorney to review the specific facts of your case.
Q. Can my friend be jailed for refusing visitation in a Florida paternity case?
A: Incarceration is a potential remedy in Florida through contempt proceedings if he willfully fails to comply with court orders. However, he may petition the court to address the paternity question under Florida Statutes, request modification of visitation due to harassment and changed circumstances, and seek protective measures from the court. I recommend consulting with a Florida family law attorney to review the specific facts of this case and determine the best course of action.
