Summary

Elena represents individuals and corporations charged with the most serious federal crimes including wire/ mail fraud, securities and bank fraud, money laundering, violations of Foreign Corrupt Practices Act (FCPA), insurance fraud, federal tax violations, cybercrimes and narcotics and weapons trafficking. In state courts, Elena represents clients charged with financial crimes, attempted murder, sex crimes, child pornography, narcotics and weapons possession, and violent assaults.

Previously, Elena worked as a Felony Assistant District Attorney at the Kings County District Attorney’s Office in Brooklyn, New York where she handled thousands of cases from arraignment to disposition. During her six years at the District Attorney’s Office, Elena investigated and prosecuted a wide array of crimes. She has tried dozens of cases to verdict, ranging from misdemeanors to violent felonies. As a Brooklyn prosecutor, Elena prosecuted several high profile cases. Notably, Elena worked on the double homicide prosecution of Nikolai Rakossi, the “Russian Rambo.”

Elena attended the night division of New York Law School and participated in Moot Court. During law school, Elena worked as an investigator for the U.S. Department of Labor Employee Benefits Security Administration. During her tenure with the Department of Labor, Elena investigated fraud, theft, and mismanagement of employer-sponsored healthcare and pension plans.

Elena graduated first in her class from the College of Management at the University of Massachusetts Boston. She completed part of her undergraduate coursework at Said Business School at the University of Oxford. Elena is fluent in Russian.

Elena is admitted to practice before the State Bar of New York, the State Bar of New Jersey, Supreme Court of the United States, the United States Court of Appeals for the Third Circuit and the following United States District Courts: SDNY, EDNY, NDNY, WDNY, DNJ and NDIL.

Q. recently i talked to a girl on omegle and she said she was of 18 years. we sexted and exchanged images and videos.
A: Yes, unfortunately you can be criminally charged. Age of consent differs state by state. I do not know where you are located, but if she's 12 exchanging and possessing naked or sexual images of her is most likely a crime in your state. It is a crime under New York Law. New York is a strict liability state- meaning, it doesn't matter whether you knew her real age. Possession or distribution of sexual images of anyone under 18 is a federal crime as well. You should consult an experienced criminal defense attorney in your state for further guidance.
Q. Is it legal for a state police investigator to take a case from a family member that works for a business
A: I don't think it's illegal per se to be the arresting officer on a family member's case. However, if the investigation was somehow skewed or done improperly, that is problematic. Since your friend took the plea, I assume he reviewed the discovery and went over the case with his attorney. Your friend should consult another attorney if he believes that this conflict of interest somehow may have impacted his case. There may be a way to take the plea back, but that will require a motion.
Q. My friend allowed me to stay at his place .he went 2 duel diagnosis center 4 help. If he has drugs in apt am I liable?
A: New York has a legal theory called "constructive possession." Under this legal theory, everyone inside the apartment can be charged with any illegal objects or substances. While the location of the drugs may influence whether the prosecutor chooses to charge you with the crime (friend's bedroom closet is different than on the living room table in open view), you can still be charged with any illegal objects in the apartment under the constructive possession theory.
