- A: The term of copyright for a particular work depends on several factors, including whether it has been published, and, if so, the date of first publication. As a general rule, for works created after January 1, 1978, copyright protection lasts for the life of the author plus an additional 70 years.
Trademark REGISTRATIONS must be maintained by periodic filing of proof of use, and may be cancelled for failure to maintain them. But even if a trademark registration has been cancelled, its owner may still have common law rights to abate infringement by usage that is confusingly similar for the same goods/services. But there are also many active registrations for UNDER THE SUN in different categories of goods/services. You should consult a qualified trademark attorney to review your proposed usage and to advise whether it may be registered.
- Q. is it possible re-register my trademark
- A: Registration No. 2745216 for the mark ACADIGM was cancelled in 2012 for the owner's failure to submit proof of continuing use in the sixth year after registration. No other application to register ACADIGM is pending. If the owner's use has continued, a new application should be filed referring to the prior registration.
