I have been a Florida practicing attorney since 1974 with extensive background and experience for the past 46 years.
I am a former Assistant State Attorney (Dade County) having worked for Richard Gerstein then Janet Reno (former U.S. Attorney).
I have worked for Servicios Legales De Miami (Legal Services of Greater Miami) manager of the Wynwood office with numerous Family cases and later working for Courshon & Berk P.A. in real estate litigation.

- A: If its a Joint Account Yes

Do they still live together? Or "separated" but in the same house?
Are the children all of the marriage and who do they live with?
Was there a prenuptial Agreement?
Is she on the Promissory Note that the mortgage secures or only on the mortgage or not at all?
Has your son consulted an attorney?
- Q. Divorce q - Are all investments owned prior to marriage but since sold then re-invested considered marital assets?
- A: Did you have prenuptial agreement?
After you sold the property that you owned prior to the marriage,did you deposit the funds in a joint account or an account you had prior to the marriage ?
You can claim a Special Equity but if the purchase of the real estate property or properties was during marriage it will be considered marital
- Q. If a spouse dies and they have credit card debt, who is responsible for paying if only the spouse is on the card?
- A: Assuming it’s a Florida probate of a Will the creditor would have to file a claim against the estate and the spouse is not responsible for the decedents credit card debt. If the estate files a timely Obligation to the Claim & serves a Notice to Creditors with that objection then the creditor would have 30 days to file a lawsuit if not the claim against the estate would be barred.
