Almost every adult needs an estate plan: will, powers of attorney, and, sometimes, a trust. When someone dies, a close relative usually needs to open an estate in order to settle the deceased's affairs and make distributions to the heirs. Because every situation is different, standardizing fees is very hard unless it is a high-volume practice (e.g., title searches). Just as you would not select a surgeon based upon price alone, your search for a lawyer involves asking good questions. For instance: 1. What cases or matters have you handled that are similar to mine, what did you decide to do, and what were the results? The answer to this question should tell you if you were in the right lawyer’s office. 2. May I contact some of your clients or former clients? The answer to this question will tell you whether his clients love, like, or dislike him. 3. What is your preferred way to keep in touch with me, and how fast could you or a member of your staff get back to me? Poor communication is the most common complaint by clients of the legal profession. Feel free to call and ask me these questions.

- A: Alabama law is more favorable to landlords than to tenants. Begin your defense with your written lease, if you have one. Even if he cannot evict you easily, he could refuse to renew your lease next time around. If you don't have a written lease, the law presumes you are a month-to-month tenant. If your lease is about to come up for renewal, you might as well find a new home rather than fight a jerk.
Don't quit paying rent, or the landlord can tell the judge you have breached the lease and he has sure grounds to evict you. If you want to stay, keep paying rent, engage a lawyer (perhaps from Birmingham Volunteer Lawyers, a pro bono group, or a similar group in your area, if there ... Read More

- A: Your HOA has an address listed somewhere in your closing documents for you to use when giving official notice.
I suggest you send a letter with photos explaining the situation via certified mail, return receipt requested.
Then send it again three days and again three days later. Keep copies of each letter.
At that point, you will should be receiving those little green receipts with somebody's signature on them at the HOA's official notice address.
Then, if the HOA pretends they never heard from you and that you are responsible for not reporting the damages, then you have a file with the certified letters and the little green receipts.

- Q. Do I have to get mortgage in my name if my spouse dies and I get the deed? They were the sole name on loan/deed.
- A: Ms. Whitehurst is correct. The only thing I would add is that the insurer of the home will likely want the home in the name of the person living in it and might threaten cancellation of insurance if title has not been transferred by deed.
