Biography

As an attorney and enrolled agent (EA), I have represented countless taxpayers before the IRS. I have worked on tax issues ranging from federal and state tax audits, tax debt collections, and appeals. I routinely have tax liens and wage and bank levies released for taxpayers.

As an attorney, I chose to practice tax law because I truly enjoy helping people who feel powerless and helpless when confronted with government bureaucracy, such as with the IRS and state tax agencies.

Tax law is considered an area of administrative law, but within its own niche. When taxpayers are up against the wall and feel defeated when facing off against the powers of the government, I feel both compelled and a duty to represent them with zealous advocacy and by using every procedural and substantive argument to my client's benefit.

Q. I have $330k CDTFA tax debt on failed during COVID S Corp. Am I personally responsible?
A: You can be held liable for the tax debt, and it appears that the CDTFA may have already made a dual determination if they placed a lien on your house.

A dual determination holds a person liable for a tax obligation shared with another, here, the corporation.

Under Revenue and Taxation Code Section 6829, a corporate officer or responsible person may be personally liable for the corporation's tax debt if specific conditions are met.

You may have a remedy under the law, such as an offer in compromise, but that will require a careful analysis of the totality of the circumstances and your current finances.
