Many factors go into what amount to demand, including, but not limited to, what past treatment you have received, what future treatment you will require, whether future surgeries will be needed to remove plating if required, how much time you have lost from work or will continue to lose if additional procedures are required, whether the truck driver was distracting or violating the rules of the road, etc. Every case is very fact-specific.

- A: Under Georgia law, for an injury to a child under the age of 7, there are two claims. One is the parental claim for medical expenses through age 18. This claim must be filed in court within two years of the date of birth. The child also has a claim for medical expenses after age 18, pain and suffering, loss of earning capacity, and future loss of earnings (if the injury will affect earnings).
