Levin Gann P.A.Lee J. Eidelberg is a former Assistant State's Attorney for Baltimore County with extensive experience in criminal and traffic court, having prosecuted many hundreds of cases during his tenure in public service, including serious felonies and misdemeanor violations. Since entering private practice more than 30 years ago, Lee has brought a unique combination of extensive trial skills, passion, and commitment to protecting his clients' rights, whether defending CDL holders charged with federal motor safety regulation violations, common motorists charged with DUI, or appearing on behalf of Maryland and out-of-state drivers charged with non-incarcerable moving violations. Lee also assertively pursues financial compensation from insurance companies for accident victims who have suffered serious bodily injuries resulting from motor vehicle collisions, work-related accidents, and medical negligence. - Q. Do I need to hand over my driver's license during a traffic stop in Maryland?
- A: The real question is why, provided there was an articulable basis for conducting the stop, you would be hesitant to provide the license? Regardless, the police take physical custody of your license to run your information through their on board computer to verify your identity, determine your driving status (valid, suspended, etc.) They can't conduct an valid investigatory traffic stop by just looking at a license through your window.
- Q. Can I contest a speeding ticket given without radar?
- A: Yes, you have the right to plead not guilty and contest the citation. However, if the Officer testifies that he conducted a "pace" of your vehicle for a specified distance and that his vehicle's speedometer was properly calibrated and found to be accurate prior to his measuring your speed, be forewarned that most judges in a "he said - he said" situation of the type you describe, may well take the Officer's word... that being said, if you have a good driving record and the speed was not egregious, a judge might spare you a conviction - and the resulting points imposed by the MVA.
