Q. What are our rights as a family regarding updates on a murder investigation in California?

A: Marsy’s Law significantly expands the rights of victims in California. Under Marsy’s Law, the California Constitution article I, § 28, section (b), victims have certain rights as enumerated in the constitutional provision.

As I read through them, however, it is unclear what kind of rights you are given as relatives of the victim of an unsolved murder. Upland is a small town along the foothills of the San Gabriel mountains, and may not have the resources of other big city police departments.

Your concerns are all valid, but I don't know what else you could do to get more timely information from the investigating officers. You might want to contact the District Attorney's office which would prosecute the case, which is the San Bernardino County DA. Go to their website, and start contacting people in that office so perhaps they can let the local police department know that the case is being monitored and is given the priority it deserves. Q. Demanding compensation due to Facebook's Real Name Policy impact.

A: Good luck trying to find any lawyer who would take on this type of situation. If you want to have any success at all, prepare a chronological statement of everything that happened, naming all witnesses, and identifying all documentation you may have which supports your claims. Focus particularly on all financial harm you claim you suffered as a result of what happened to you. Once you have completed that statement, collect all your documents and make copies of all of them, and put it all into a package, and then send it out to all the attorneys you can find. Make sure you keep your originals of all your documents and other evidence which may support your claims.

Q. Is it legal for a prosecutor to threaten to double my time during a prelim if found guilty?

A: A prosecutor has no power to add to or subtract from time served. That is up to the judge who hears your case, and depends on whether you are convicted or not. This sounds like an intimidation tactic by the deputy DA, and you should feel perfectly comfortable with your appointed public defender to discuss this with him or her. You should share your concerns with your attorney, because obviously the attorney is supposed to be working for you.
