Mr. Breakstone’s significant recoveries include: $10.2 million for a baby who suffered brain damage due to ambulance negligence; $7.5 million for a propane gas explosion and wrongful death and $7.5 million for a baby who suffered brain damage due to medical malpractice.
Mr. Breakstone’s $10.2 million recovery against a national ambulance company led to fundamental regulatory changes with ambulance incident reporting in Massachusetts. His $1 million settlement for a spinal fusion patient who was abandoned by a surgeon at Mount Auburn Hospital resulted in a new hospital policy to inform patients if a doctor is suspended.
In 2012, Mr. Breakstone obtained a $7.5 million settlement for the family of an electrician who was killed in a propane gas explosion in Norfolk, Mass. Mr. Breakstone is known for his results for clients injured in public transportation accidents and pedestrians who have been injured or killed in bus accidents. He has handled numerous cases involving the MBTA and won at trial and appeal, including a $7.1 million award for a pedestrian who was struck by a bus and seriously injured in a crosswalk.
