3 Questions Answered
Q. my girlfriend is pregnant and resides in USA with me but how do I go about her staying here
A: I agree with the information that my colleagues provided in terms of options. With that being said, my opinion is that the best first step would be to meet with an experienced and knowledgeable immigration lawyer to discuss the options, necessary procedures, and timeline. This way, you can work with the lawyer to establish and implement a strategy that will make the most sense and will accomplish your goals.
Q. My British husband is in the US on a travel visa. I'd like to sponsor him for a green card as my spouse.
A: The I-485, rather than the I-539, is used for the Green Card process. There are other applications, as well, such as Form I-130. The best advice that I can give is to consider speaking with a knowledgeable and experienced immigration lawyer who can guide you through the process, and who can counsel you and your husband as to the requirements, needed application documents, etc.
Q. My British husband is in the US on a travel visa. He only came to visit me and our daughter with a return ticket.
A: I agree with my colleagues that consulting with a qualified and knowledgeable immigration lawyer would be the best first step. The Green Card process is complicated, and it is best to seek the guidance of an immigration lawyer who has been through the process many times, is knowledgable about the requirements, and can counsel you and your husband as to the best course of action. There may or may not be a personal interview by the USCIS as part of the process, and such a lawyer can make sure that you and your husband are well prepared for the interview; the lawyer can attend the interview with you.
