Legal Answers
157 Questions Answered
Q. Can I ask the attorney what questions they will ask me at a deposition prior to the meeting?
A: It depends. If it is a true oral disposition then anything is fair game. Your attorney may object but you are still required to answer the question. Objections are typically resolved after the fact.

That being said, there are very limited instances where your attorney may stop the deposition, discuss with the judge, and get a ruling. But these are extremely rare. If the question is at all on topic, then it is probably fair game.

Q. What are Colorado laws regarding inheriting property held as tenants in common?
A: Typically, if no will exists then the state’s intestacy statute would govern. If you have questions you should contact an attorney.

You will most likely need to open probate and resolve any property issues that way. For Tenants In Common, ownership typically passes without regard to the other owner. Joint Tenancy With The Right Of Survivorship is different. You need someone to look at the deeds, check for wills, and then determine what everyone should have. This is not something that can or should be done in this forum.
Q. can you share your political views in your classroom if you're a teacher in colorado
A: Aw, the question of does the 1st amendment apply in a classroom. The answer is that it depends. Private schools have no obligation to allow free speech. The 1st amendment only applies to government actors. Now some schools will permit such speech because it is good for the learning environment.

Now, if you teach at a public school then it becomes a much more complicated question. Sorry, you would need to discuss your situation with an attorney. You need to consider how the school will react; how your students will react; if your speech is detrimental to your job; the type of speech, and so on.

Typically fighting words, profanity, and certain types of speech while speech may not be permitted in certain environments. It makes sense. If I walk into a courthouse yelling about my political beliefs, it does not matter if the topic is political because I am interrupting the court. Hence, time, place, and manner restrictions.

Unfortunately, if you are really concerned you need to talk to an attorney to try to flush out how far you can push a subject. Welcome to Amercia 2024.
