Biography

Michael Mayoral is a shareholder and founder of Perez Mayoral, P.A. His practice focuses on multiple areas of civil litigation, including negligent security, homeowner's insurance claims, personal injury, business law, and real estate transactions.

Michael has worked on several high stakes matters in state and federal court throughout the Southeastern United States. As a civil litigator, Michael served as counsel in many insurance claim related matters and injury-related cases, including car and trucking accidents, slip-and-falls, negligent security, and toxic torts. He recently led the representation of a large number of plaintiffs who developed leukemia and other blood-related cancers subsequent to working as part of the 2010 Deepwater Horizon Oil Spill clean-up response. He has handled negligent security cases involving shootings resulting in catastrophic injuries and paralysis.

Michael has experience in representing the interests of people and businesses in state and federal court. He previously served as counsel for a publicly-listed real estate investment trust, where he handled the company’s landlord-tenant related litigation. He has also represented apartment buildings, home-owner’s associations, and property management companies throughout the state of Florida.

Michael has a strong passion for legal advocacy, especially when he has the opportunity to represent disadvantaged members of the community. Throughout his career, Michael has maintained a passion for criminal defense. He has successfully represented clients in cases involving attempted murder, armed cocaine trafficking, cargo theft, drug trafficking, shootings, and insurance fraud. He has taken cases to trial involving most any crime and obtained acquittals in the great majority of those cases. He has also litigated Florida’s Stand Your Ground law in state court several times and has served on law school panels on the subject.

Q. My HOA in Florida is demanding me to get rid of my registered service dog after he launched at a valet guy while muzzled
A: You should consult with an attorney experienced in representing homeowners against their HOAs. There are several different defenses to this claim based on the language of the governing documents. Also, there are DBPR opinions on this issue finding a dog not to be a nuisance depending on the circumstances. All of these claims are extremely fact specific, and depend on your governing documents.
Q. I've been buying a house from an individual or contract is listed at the courthouse she's refusing payments
A: You absolutely need an attorney to handle this for you. The contract and real estate law issues you are dealing with are fairly complicated. There is unfortunately no way to give you a direct answer or guide you through the process through here due to the issues involved. You should at least set up a free consultation with a couple of attorneys who handle breach of contract and real estate litigation cases.
Q. Can a contractee void a contract (and not pay) after work is performed because I refuse to comply with "due dilligence"?
A: It sounds like you may very well have a valid cause of action for breach of contract, unjust enrichment and/or quantum meruit. You are most likely owed the value of the work you performed. You should set up a consultation with an attorney who handles breach of contract disputes, present the contracts, and get their opinion as to what rights and options you have under the circumstances.
