- Q. Is it still a felony if my wife cheats we got married in NM but been living here in Tulsa since last year
- A: Technically, yes. It's not where the marriage takes place, but where the adultery takes place that matters. So, if adultery takes place in Oklahoma, then Oklahoma has jurisdiction to prosecute the crime of adultery under Oklahoma law. However, the statute which makes adultery a crime in Oklahoma is generally regarded as being archaic (and probably unconstitutional), and law enforcement officials have other prosecutorial priorities. I've wondered what would happen if a victim of adultery insisted on filing a police report and pressed their local authorities to pursue an investigation. - A: Why an annulment instead of a divorce? This is something you should discuss with your divorce attorney when you have your consultation.
- Q. Should the stimulus be split between parents with 50/50 custody?
- A: I wonder what your divorce decree and child custody and support orders say as the provisions of those documents might provide some guidance as to your options. Its probably best to ask your divorce attorney. Generally speaking, I'm not sure there is much you can do that wouldn't cost more in legal fees than the payment is worth beside maybe writing a letter and hoping your former spouse responds favorably to the pressure.
