I founded my firm with the goal of better serving individuals and businesses across South Florida struggling with debt, foreclosure, and loss. The topic: “The New Bankruptcy Forms Petition, Schedules and SOFAs.” Van Horn focused on pre-filing review issues and the intake process. Attorneys and paralegals attended the class and received Continuing Legal Education credit for the course.

- Q. My husband and I paid for a chapter 7 bankruptcy but never ended up filing, can I get the money back from the attorney?
- A: Did you sign a retainer or engagement letter? If so, you should review that to determine your rights. If the fee is non-refundable you would not have a right to get it back but the attorney may work with you on a partial refund.
- Q. Can I file bankruptcy if I have a judgement against me that I can't afford to pay.
- A: Absolutely. Judgments are one of the main reasons that individuals chose to file bankruptcy. You may want to move quickly as once the creditor receives the judgment, they can engage in post-judgment activities like garnishment or seizure of assets.
- Q. Can I apply for a loan and still file for chapter 7 if I am denied the loan?
- A: Applying for the loan will have no impact on your bankruptcy filing. This happens quite often as people try to avoid bankruptcy by getting a consolidation loan.
