We also represent and advise private lenders to ensure compliance with (or, when possible, avoidance of) the myriad of both federal and state regulatory schemes, including Truth-in-Lending, Dodd-Frank, the Florida Fair Lending Act, and usury law. As part of our title and closing services, we prepare and provide customized mortgage and loan legal documentation for private lenders, assuring them of having a valid, strong, and legally enforceable debt and security interest in the borrower’s property. Our firm can establish a real estate investment structure allowing the use of funds held in retirement accounts (such as IRA’s) for the purchase and ownership of investment real estate, providing access to these funds and having the income and capital appreciation or gains accumulate inside of the IRA, tax-free. We especially recommend and can implement the use of Florida Land Trusts as an ideal method of acquiring and owning investment real property.
