Nicholas S. Ratush, Esq., is licensed to practice before State and Federal Courts of the Commonwealth of Massachusetts and the State of New York.

Nicholas Ratush believes that effective client representation starts with a thorough examination of every detail of a case. That process often leads him to discover the vital pieces of information that are essential to develop highly effective strategies for dealing with the issues presented.

Nicholas was born in Kiev, Ukraine and grew up in New York. He received his Bachelor of Business Administration from Pace University majoring in Information Systems. He received his Juris Doctorate from the Brooklyn Law School in 2005 and has been practicing law since 2006. He also achieved his Master of Laws degree from the New York Law School with a concentration in Tax Law / Estate Planning.

Q. Who gets IRA payout when someone dies without beneficiary in IRA but with a will and living trust? Can it go to trust?
A: Typically the default beneficiary, when one isn't designated, is the estate of the decedent. This means that you will probably have to go through probate.

1) Confirm this with the financial institution what documents they will require to access the funds;

2) Contact your local court and / or local attorney to get appointed as executor, personal representative etc.

3) Talk to a tax attorney about strategies for taking the money out of the IRA once you are appointed. There are options and some are more advantageous.
