Paul A. Schofield has over a decade of experience helping individuals and corporations to navigate the bankruptcy process. Prior to opening The Schofield Law Firm, P.C., Paul gained unique knowledge and insight into bankruptcy law while serving as a law clerk of the Honorable John S. Dalis, United States Bankruptcy Judge for the Brunswick and Waycross Divisions of the Southern District of Georgia. He also represents clients in probate matters, and in negotiations with the IRS and Georgia Department of Revenue to resolve tax issues. Q. Do I need a debt collection attorney?
A: You should speak with a bankruptcy attorney. In general, bankruptcy treats payments ordered through a divorce as one of two things - a domestic support obligation (child support or alimony) or a property settlement (basically everything else). In a chapter 7 bankruptcy case, neither can be discharged (eliminated). In a chapter 13 bankruptcy case, domestic support obligations cannot be discharged, but property settlements are dischargeable.

A bankruptcy attorney should be able to look at both your divorce decree and the court docket of your ex-husband's bankruptcy and be able to tell you whether you can collect on that debt and what your options are. Attempting to collect without knowing that information could mean that you are violating either the automatic stay or the bankruptcy discharge injunction, so make sure you get some advice that is specific to your situation. ... Q. Me and my husband filled Ch.7 bankruptcy and my husbands check is being garnished for a car that was discharged.
A: Unfortunately, there is usually no way to force a lender to repossess a vehicle. In most cases the lender has the option to NOT repossess the vehicle. However, it sounds like the lender in your case wants to take possession of the vehicle given that they told you they just could not find it. It might help to contact the lender (or have your bankruptcy attorney do so) to try and make arrangements to drop the vehicle off at a place of their choosing (such as at a tow company they work with) because, as Mr. Denison stated, the tow fees are a postpetition debt, so your husband will continue to be responsible for those fees.
