Q. If you back into someone in a parking lot with a car that you do not have insurance for are you held reliable for damage
A: Yes you would be liable for the property damage to the other vehicle. I am assuming the gist of your question is insurance coverage. You stated that the vehicle you were operating that caused the damage to the other vehicle was uninsured. Nevertheless, liability would remain and thus you would be responsible.
Q. When do I send out my demand letter?
A: I generally send out a demand letter after my client has completed all of their medical care and with the letter I would enclose or attach a list of all medical providers with the amount of their respective bills. I would also enclose or attache with the letter all of your related medical records and proof of lost time from your work. If you have photos of the place where you were injured that may help your cause, include those as well. I would not give a statement to an insurance adjuster if asked. I would also recommend and in fact urge you get some legal advice even if you are committed to handling your case on your own. Insurance companies delight in paying much less when an injured party makes such a claim without legal representation.
Q. Medical related, is this a case?
A: It could be a case, but like all potential medical negligence cases in Illinois, the entire hospital and medical charts would have to be reviewed. A doctor practicing in the same or similar practice of medicine as those who may be negligent would have to be able to author a certificate of merit stating that there was a deviation from the standard of care that was a cause of your relative's demise. So that short answer as whether there is a case or not is dependent on that review of the records.
