Ronald J. Eisenberg
Business law, class actions, contracts, commercial collections, and litigation.
I have represented hundred of parties, both plaintiffs and defendants, in lawsuits in state and federal courts. My favorite cases are class actions under the Telephone Consumer Protection Act (TCPA) targeting senders of annoying and illegal junk faxes, robocalls, and text messages. I have litigated more than 175 class action lawsuits and been appointed as Class Counsel multiple times. Class actions are great way to level the playing field between consumers and large corporations.
Among my many other practice areas are contracts, collections, landlord tenant law, and foreign judgment registration. I am frequently hired by tenants who wish to keep their old, resolved judgments from continuing to show up on the court's website and preventing them from obtaining housing.
Outside of my law practice, I am an avid marathon runner, having completed more than 50 marathons, including running 100 miles in less than 24 hours, and I also enjoy fishing and global travel.

- Q. How to handle eviction after paying full balance in MO?
- A: Without reviewing the docket it wouldn’t be possible for an attorney to provide you with an informed assessment. If the judgment were a default judgment then perhaps a motion to set aside default judgment and quash the writ could be filed. It seems odd that the landlord would have waited many months to have a writ issued. There must be more to the situation than that you fully paid the judgment within 10 days of entry, continued living there five months and paying all rent due and now the landlord suddenly filed a writ.
- Q. Can a credit card company place a lien on my car for debt if they sue me?
- A: If you are sued in the associate division and a judgment is entered against you, the plaintiff may "transcribe" the judgment to make it a real estate lien. It's not a vehicle lien but the plaintiff my seek an execution to have the sheriff seize and sell the vehicle. Hire a local attorney to represent you if you can.
- Q. How long do I have to remove my belongings from a foreclosed property in MO?
- A: If you wish to avoid a damaging judgment it would be wise to vacate before a lawsuit is filed. Otherwise, you’ll likely be sued for unlawful detainer, have a judgment for double rent imposed, and 10 days after entry of judgment the plaintiff will apply for a writ of execution for the sheriff to come and remove you.
