Biography

I was born and grew up in the area - my family has served the legal needs of the area since 1892, over 120 years. My goal is to explain the legal process in plain English and to avoid the 'technical lawyer words' which only confuse many people. The primary focus of my firm is now "Elder Law" which broadly includes estate planning, Nursing Home admissions and Medicaid applications and adult guardianship. After a family member dies, we advise and assist in the estate administration process. In short, we help families plan and deal with aging and death and navigating the legal system.

    We charge a modest consultation fee which is less than half of the normal hourly rate for professional services. Our consultation usually takes an hour and frequently provides advice and information that the individual can use immediately. The fee for continued services is discussed at the consultation.

Q. My landlord sent me a copy of a water bill. But there was no address, account number ect. It's got be a fake, what can I
A: You have your question backwards. It's up to the landlord to prove it's the bill for your property. You might call the water utility and ask about billing at your address.
Q. What is the Virginia statute of limitations involving a third party promissory note with a deed of trust?
A: You've left out some important information - when was the mortgage taken out, when was it's original due date, and a few other things. I have a lot more questions than answers at this point.

That said, the odds are that the holder of the debt may still be able to foreclose on the property. it is an attempt to collect a debt so you have the right to ask for full verification of the debt, the payment history, and so forth.

You need to meet with an experienced real estate and/or collection defense attorney to review everything you have on the account and help you get verifications.
Q. Can the estate be responsible for the medical bills of the decedent ?
A: Handling of estates is a lot more technical than most people think, and you should consult an experienced probate attorney to review the estate and advise you. If there is no estate under administration (through the court system) you - as an individual - are generally not responsible for the decedent's debts unless you are a co-signer on the debt or otherwise agreed, in writing, to pay them. Certain medical bills may be your responsibility (as an individual) but that is rare. If there is formal administration then the executor/administrator must pay the debts if there are sufficient funds.
