Q. Can you take out a 401k loan while under Chapter 13?
A: In New Jersey, you would need to request permission from the Chapter 13 Trustee to take funds from an exempt asset for current use because there maybe tax ramifications.
Q. Do I need a bankruptcy lawyer?
A: It is possible to see, although I do not recommend it. Your tax dent will not go away as neither will the student loan debt
Q. My home was discharged in bankruptcy; I received a modification, I am now delinquent; am I liable in a short sale?
A: You have to review your loan modification documents. It would behoove you to review with your attorney
Q. Can you help someone get out of debt who has no money?
A: Her best bet is to go to Essex-Newark Legal Services, 5 Commerce Street, 4th Floor, Newark, NJ 07102 973 624-4500, as they provide bankruptcy assistance to those who can not afford Counsel.
Q. If I file bankruptcy will interest and penalties continue to accrue on my delinquent real estate tax?
A: If a tax sale certificate has been issued and bought the answer is yes
Q. Need help to apply for bankruptcy, I’m on disability
A: You should have no problem as the SSDI will qualify for payments to be made under a reaffirmation for the vehicle.
Q. If a person files bankruptcy, but doesn't include accounts in good standing, are the good accounts affected?
A: Upon filing ALL accounts related or linked to your social security number are closed. You can call the credit card company and see about reopening, but they usually do not do, unless AMEX
Q. I am thinking about filing bankruptcy. Can I max my cards before hand?
A: Absolutely not. Would be considered fraudulent purchases never having an intent to repay. Any purchases within 75 days of filing are circumspect if they are not ordinary expenses.
Q. Do bankruptcy judges usually approve someone to hire a lawyer?
A: Usually only if a chapter 11 or 13 do judge's have to approve outside counsel
