A: That is a great question and should be explored because if the "owner" was still the seller and had permitted the "buyer" to drive the car before the sale was consumated then that might work. As for the at fault driver - the police will investigate and the DA will decide whether to charge or not. The victim doesn't get to make that decision. A: One of the previous answers suggesting there may be a civil case cross-over is very good and something you should look into. Depending on how the injury occurred there may be options outside of the Work Comp arena. If a 3rd party had some responsibility for the injury you may be able to also go after them. You should explore that possibility while also finding a good work comp attorney. We have worked on such type of cases along side the work comp attorney. good luck to you...
