Contingent Fees
In disability cases, you only owe a legal fee if we win your case. In most Social Security cases, this fee is 25% of your backpay benefits (the lump sum amount you receive when you win an award of benefits), with a maximum fee of $6000. In Veterans cases, the fee is 20% of your backpay. In certain cases meeting very specific requirements, fees can exceed the above amounts - however, this is not common. If your case appears to be one of these cases, I will make you aware of that BEFORE you hire me. If I do not, I will not charge you more than the above amounts even if your case is one where a lawyer ordinarily would charge more. In addition to legal fees, disability attorneys do usually have to to request and pay for medical or other records, as well as pay for postage, travel and parking at your hearing, or other expenses. In most cases, these expenses total anywhere from $100 to $500. Some lawyers require you to pay these costs upfront, however I find it easier and more manageable to pay for these things without requiring clients to come up with the money first. You will ultimately be responsible for these costs, and a bill for reimbursement of these expenses will be sent to you at the end of your case. These costs are to be repaid regardless of whether we win or lose your case. -
Rates, Retainers and Additional Information
Legal fees for bankruptcy cases vary greatly. For most Chapter 7 cases, the fee is between $700 and $1500, depending upon the complexity of the case. Chapter 7 fees must be paid in full BEFORE your case will be filed. For most Chapter 13 cases, the fee is between $2000 and $4000. Approximately HALF OF YOUR FEE must be paid before your case will be filed.
