Biography

Since 1999 I have labored to establish divorce settlements that are firm but fair and parenting-time schedules that work. Relocating and long-distance parenting plans. I resolve high-conflict situations, protective orders, and deal with parental alienation. I also have litigated a number of high value cases in both Summit and Stark Counties.

My firm also has handled a great number of high value transactions involving mineral rights, land leases and easements with energy companies. We have done joint ventures, partnerships, S corporations, LLCs, commercial and industrial developments, condominium developments or conversions and office building sales and purchases. Likewise, I have drafted construction contracts, lease negotiation and preparations, loan workouts and foreclosures as well as sale and purchase contracts.

Notably, I am among a handful of Ohio Attorneys who practice special education law. My focus in this area is on the parents of special needs children. I aid them in ensuring that these children receive the free and appropriate public education (FAPE) that each child is guaranteed under state and federal law.

Q. Can I contest my child's father's income and custody misrepresentations?
A: After you receive a finding from the Child Support Enforcement Agency, you should also receive information on how to appeal the decision or rather file an objection. Send in that paperwork as the instruction states. An additional hearing will then be set up, and in the meanwhile, it would be wise to hire an attorney so that discovery of any additional documents may be conducted in order to prove what you allege. Likewise, if you already have documents that demonstrate that your child's father has misstated the facts, you may use them as either part of your direct testimony and / or to cross examine him. Again, you are more likely to be successful if you have an attorney who understands how to properly get evidence authenticated and admitted. Search for an attorney who regularly practices custody and domestic relations law in the county in which this is occurring. Good Luck ... Read More
Q. Should I report to law enforcement if I find a tracking device in my child's belongings?
A: I differ slightly. I would want to know about your co-parenting relationship. How well do you and the other parent communicate? What does your custody agreement say about monitoring the child? Does your custody agreement have a provision for how you should communicate about substantial differences? Only you can figure out whether or not this is an issue can raise with the other parent. Prior to running to law enforcement, you may wish to actually address this issue with the other parent. You should preferably do so in writing, keeping the discussion neutral and judgment free. Likewise I would want to know how old the child is that we're talking about. Was the child involved in this decision? Again if after discussing the matter with the other parent or at least writing the other parent about this matter, you are not satisfied with the answers then definitely make a report to law enforcement and document what you found. ... Q. Should I sue for fraud in a house purchase with substantial evidence?
A: While it certainly sounds like you may have grounds for a suit, you need to have several things reviewed by an attorney who regularly practices in real estate litigation. It may cost you a few hundred dollars just to have this evaluated, but it will ultimately be worthwhile even if you do not actually have a good case. This forum is no Substitute for having the residential real property disclosure form, and your purchase agreement being reviewed by an attorney.

For example, you claim that they didn't allow you to conduct an independent expansion inspection. As I review this, I wonder "what does that mean?" Did they refuse in writing? What was the last thing in writing between you and the seller? All of these are documents you would want to produce to an attorney who can review whether or not you have a case worth pursuing.

Those documents, along with your closing statement, will better explain what you've already agreed to regarding items that the inspections may have revealed and those things that have already been claimed by the seller. You'll need that and documentation of the amount of damages you have already incurred that you believe are approximately caused by the fraudulent failures to disclose by the seller.
