Q. How long is the removal process from an LLC in New York with no outlined process in an agreement?
A: It all depends on how you would like to terminate your association as a member. If you just want to be "out" and there is no op agreement in place, you may want to have all the members sign a LLC resolution (in lieu of a special meeting) indicating that the LLC (and all the members) agrees with your resignation with no further liability on your end as a member, etc.
Q. Can I change a NJ careless driving ticket to unsafe driving to avoid points?
A: Depending on where your case will be heard, you may want to consider to hire an attorney who knows the personality and operation of the local court. Your lawyer may be able to get your case dismissed on various grounds including lack of prosecution. Unsafe operation is a rip off catch-all moving violation abusively used in NJ municipal courts which can cost you more than $450, and use of the amendment is not restriction free. If you inadvertently plead to the rip-off no-pointer without thinking or knowing, you can end up getting points imposed on your license (if a NJ license).
Q. Is statute 39:4-67 a moving violation in New Jersey?
A: 4-67 is a no-point moving violation. It is considered to be a moving violation in your jurisdiction. The fine is typically less than $100 except for some townships in NJ. Depending on the surrounding factors, evidence and your availability, you may ask for a trial. No jury trial is available in local courts in NJ, but you have the right to go to trial. Even if you were found guilty of the charge at the end of the trial, again, this is a no point violation and jail time or suspension is unlikely.

However, it's strongly recommended that you consult with a local attorney who knows the personality of the court judge and prosecutor.
