- Q. How long is the removal process from an LLC in New York with no outlined process in an agreement?
- A: It all depends on how you would like to terminate your association as a member. If you just want to be "out" and there is no op agreement in place, you may want to have all the members sign a LLC resolution (in lieu of a special meeting) indicating that the LLC (and all the members) agrees with your resignation with no further liability on your end as a member, etc.

Depending on the surrounding factors, evidence and your availability, you may ask for a trial. No jury trial is available in local courts in NJ, but you have the right to go to trial. Even if you were found guilty of the charge at the end of the trial, again, this is a no point violation and jail time or suspension is unlikely.
However, it's strongly recommended that you consult with a local attorney who knows the personality of the court judge and prosecutor. Some municipal judges in NJ are full of nonsense and exercise ... Read More
