I advocate determining the outcome of potential patent interferences before a request for interference is filed. Patent interferences can be identified early in prosecution when reviewing cited references if the reviewer is trained to recognize interfering subject matter. Once identified, an interference proceeding can be focused on the right issues or avoided.
