Dominique Young
A femmepreneur advocating for other femmepreneurs.
I'm a graduate of the illustrious Women's College at Brenau University where I obtained a Bachelors of Fine Arts in Arts Management. The following year I enrolled at Florida A&M University College of Law where I learned everything from Environmental Law to International Business Law. In 2011, I earned my Juris Doctorate and passed the Florida Bar Exam later that year.
While working with a private law firm, I enrolled at the University of Alabama School of Law for a Master of Laws in Business Transactions where my focus was Business Law, Intellectual Property, and Tax Law. I earned my LL.M. in 2016. Today, I am licensed in Georgia, the Northern District of Georgia, and the U.S. Tax Court, as well as Florida, and a small business owner, just like you.
Before starting my own firm, I worked for law firms with major corporate clients in different fields of law as a litigation attorney. I also worked for a state government entity in the General Counsel's Office. I have experience handling non-jury trials, negotiations and mediations, and successfully conducting motion hearings on behalf of my clients. My knowledge regarding the needs of small business is vast and useful to enterprising women. I hope we can develop a great connection and work together for years to come.

- Q. I want to use a domain name that is similar to the name of an exisitng business that provide the identical service
- A: Probably not. You are essentially causing confusion to the masses regarding words or images that are associated with another business with a similar service. Just because the domain name is available, does not mean that you can register it with the USPTO. I would suggest using a different business name. This is based solely off the few facts that you have provided in this question. There are options that you can obtain from an trademark attorney. I would consult with them regarding your use of that domain name.
- Q. If there's a trademark pending, that includes a word your own products will use, does it stop you using the word?
- A: This would depend on the class your good or service is being registered and whether there would be a likelihood of confusion regarding your mark and the mark that is currently pending. If a mark shows pending, the application has been submitted and they are waiting on the trademark examining attorney to approve the application. USPTO trademark works on first in time first in right, basically whoever files first get the right first, unless there are other circumstances regarding. For an application such as this, I would definitely consult with a trademark attorney to assist you with this trademark application. There is the possibility that you can use the word in your business, however, an ... Read More
- Q. Am I violating the trademark if I use the name “Good Grief!” for my ministry of funeral and graveside services?
- A: You would have to conduct a USPTO trademark search to see if the words have already been registered by another business or individual. Then I would conduct a more comprehensive search with a trademark search company to see if another business/individual has registered the word phrase. If not, then the word phrase can be submitted to the USPTO for trademark registration. I would consult with a trademark attorney to complete this process and to submit the trademark application.
